These Terms of Service and Conditions ("Terms & Conditions") govern your access to and use of lifx.com, the LIFX mobile applications, and LIFX connected smart lighting products, which are owned and operated by LIFX, a brand of Feit Electric Company, Inc. ("LIFX," "we," "our," or "us"). Please read them carefully. By accessing or using any of our services, you agree to be bound by these Terms & Conditions.

1. Acceptance of Terms

By accessing or using lifx.com, any LIFX online store, application, or connected product (collectively, the "Services"), or by creating a LIFX account, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Services.

If you are using the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" will include that entity.

We reserve the right to revise these Terms at any time. We will provide notice of material changes by posting a revised version on lifx.com with an updated "Last Updated" date. Your continued use of the Services after the effective date of any revision constitutes your acceptance of the revised Terms.

2. Eligibility

The Services are intended for users who are at least 18 years of age, or the age of majority in their jurisdiction if higher. You must meet this requirement to make a purchase or create an account on lifx.com. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement. If you are under 18, you may use the Services only with the involvement and supervision of a parent or guardian.

You may not use the Services if you are located in a country subject to a U.S. government embargo or are listed on any U.S. government list of prohibited or restricted parties.

3. Accounts

• Certain features of the Services (such as managing devices, orders, and preferences) require you to create a LIFX account. When registering, you agree to: provide accurate, current, and complete information; maintain and promptly update that information to keep it accurate and complete; keep your username, password, and security questions confidential and not disclose them to any third party; restrict access to your account and devices; notify us immediately of any unauthorized use of your account at [email protected]; and accept responsibility for all activity that occurs under your account.
  
  
• LIFX is not responsible for any loss or damage arising from your failure to safeguard your login credentials.
  
  
• We reserve the right to suspend or terminate your account, or deny access to the Services, at our sole discretion and without prior notice, if we reasonably believe you have violated these Terms or applicable law, or have engaged in fraudulent, abusive, or unlawful behavior. You may close your account at any time by contacting us. Termination does not relieve you of obligations accrued prior to termination.

4. Products, Orders, Purchases and Returns

• We make every effort to display accurate product descriptions, specifications, images, and pricing on lifx.com. However, we do not warrant that product descriptions or other content are complete, accurate, reliable, current, or error-free. If a product offered on our site is not as described, your sole remedy is to return it in accordance with our Return Policy found below. Product availability is subject to change without notice. We reserve the right to limit quantities of any product sold, including per person or per household.
  
  
• All prices are in U.S. dollars unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct pricing errors or inaccuracies and to refuse or cancel orders if a product is listed at an incorrect price, whether due to typographical error or otherwise, or if we suspect fraud or unauthorized activity. We accept payment via major credit cards, debit cards, and other payment methods as indicated at checkout. By submitting a payment, you represent and warrant that you are authorized to use the payment method provided. All payments are processed through Shopify and its authorized payment processors; LIFX and Feit Electric do not store raw payment card data. Sales tax will be applied where required by applicable law.
  
  
• Your placement of an order constitutes an offer to purchase the selected products. Our acknowledgment of an order (by email or otherwise) does not constitute acceptance of your offer. A binding contract is formed when we ship the ordered product. We reserve the right to cancel any order for any reason prior to shipment and will issue a full refund if payment has been charged.
  
  
• Orders are fulfilled through our logistics and shipping partners. LIFX currently ships to addresses within the continental United States only.  We’re unable to deliver to Alaska, Hawaii, U.S. territories (including Puerto Rico and Guam), or P.O. boxes at this time.  Orders are prepared with care and typically ship within 1–2 business days. During periods of high demand, processing may take slightly longer.  If we expect a significant delay, we’ll notify you by email.
  
  Delivery Options, Timing and Cost:
  
  Available shipping options—such as Standard and Express—will appear at checkout.  Estimated delivery times are calculated from the date your order ships, not from the date of purchase.  Once your order is shipped, you’ll receive an email confirmation with your tracking number. Please note that actual delivery times may vary based on your location, carrier performance, and external factors (e.g., weather, holidays).
  
  Shipping charges are calculated and displayed at checkout before you complete your order.  Promotional free-shipping offers (when available) apply only to qualifying orders and destinations as specified in the offer terms.
  
  Once the carrier accepts the shipment from our fulfillment center, you assume ownership and responsibility for the goods, including any risk of loss, theft, or damage that occurs after the package has been handed off to the carrier.  LIFX is not responsible for:  Delays, loss, or damage occurring after the carrier takes possession of your order; or Packages returned to us due to an incorrect address or refusal upon delivery; or Packages that are lost or stolen after a confirmed delivery scan by the carrier. To reship, additional shipping charges will apply.

• Return Policy - You may return your product within 30 days of delivery for a refund or exchange.  To be eligible for a return, items must be brand new, unused, unopened, and in original condition, with all packaging, manuals, and accessories included.  Proof of purchase (such as your order number) is required.
  
  Products that are damaged due to misuse, neglect, or modification are not eligible for return. We reserve the right, at our sole discretion, to apply a restocking fee or deny a return if the returned item does not meet the conditions outlined in our return policy. See Non-Returnable Items below.
  
  How to Start a Return:
  
  Contact our team via Chat at lifx.com or at https://support.lifx.com, and we will provide detailed instructions and a Return Authorization (RA) number.  Ship the product back following the provided instructions. Unauthorized returns may not be accepted. Refunds are issued to your original payment method within 5–10 business days after we receive and inspect your return.  A flat return shipping fee of $14.99 will be deducted from your refund for each return shipment.  Exchanges are available only while stock permits. If and item is no longer available, we may chose to replace it with a comparable item of equal value.
  
  Non-Returnable Items:
  
  Certain items cannot be returned, including:  Any visibly used, opened, modified or damaged items; All refurbished, open-box, clearance, or final-sale items; Products purchased from unauthorized resellers or third-party marketplaces; and Products that are missing accessories.

5. Mobile Applications — License

Subject to your compliance with these Terms, LIFX grants you a limited, non-exclusive, non-transferable, revocable license to download and use the LIFX mobile application (the "App") on devices you own or control, solely for your personal, non-commercial use.

• You may not: copy, modify, translate, or create derivative works of the App; reverse-engineer, decompile, disassemble, or attempt to extract source code from the App, except as expressly permitted by applicable law; rent, lease, lend, sell, sublicense, or otherwise redistribute the App; use the App on a device you do not own or control; remove, alter, or obscure any proprietary notices in or on the App; or use the App for any purpose other than its intended use in connection with LIFX products.
  
  
• If you download the App from the Apple App Store, the Apple Media Services Terms and Conditions apply in addition to these Terms. Apple is not a party to these Terms and has no obligation to provide maintenance, support, warranties, or product claims with respect to the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no further warranty obligation with respect to the App. If you download the App from the Google Play Store, Google's terms apply in addition to these Terms.
  
  
• We may issue updates, patches, or new versions of the App at any time. We may update or modify App features at any time to improve performance, add functionality, or maintain security. We may terminate your license to use the App at any time if you breach these Terms. Upon termination, you must cease all use and delete all copies of the App from your devices.

6. Connected Products — Additional Terms

• LIFX grants you a limited, non-exclusive, non-transferable license to use the firmware embedded in LIFX connected products solely to operate those products for their intended purpose. You may not modify, reverse-engineer, or extract firmware.
  
  
• Some LIFX products and features require an internet connection and use of the App or web services. You agree to: maintain a stable internet connection and a compatible device; and install firmware or software updates that may be required for certain features. You acknowledge that service performance may vary depending on network conditions. Data collected through App use is governed by our Privacy Policy.
  
  
• Our connected products may be integrated with third-party smart home platforms (e.g., Amazon Alexa, Google Home, Apple Home, Samsung SmartThings and others). Your use of those platforms is governed by their respective terms of service and privacy policies. LIFX is not responsible for third-party platform availability, accuracy, or terms.
  
  
• Device security.  All devices that connect to the internet hold inherent security risk.  It’s up to manufacturers like us to ensure that we are doing everything we reasonably can to protect you. With that in mind, here is an update of what we are doing to protect our devices, and what you can do, to protect yourself from a possible hack.
  
  A network is only as secure as its weakest link. Don’t let your home’s network, or you, be that link. There are two things to think about here: i) your network and ii) your words.
  
  Secure the wireless network - The old Wired Equivalent Privacy (WEP) protocol is still widely used, but not the best. Better to use the Wi-Fi Protected Access II (WPA2) protocol and a strong, complex password. Disable guest network access entirely - And be strict about who — or what — can get on the network.
  
  What we’re doing at LIFX to secure our devices - As a part of our ongoing commitment to security, we have made improvements to data encryption across devices and will continue to enhance all our devices through regular firmware and software updates. We’d love to go into detail on what those details are but, for obvious reasons, that would not be good practice for the security of your products. We are also working with security consultants to ensure we are always vigilant and aware of the key security issues in smart home.
  
  Connected product features that depend on cloud connectivity (scheduling, remote access, automations, and similar features) require internet access and active operation of our cloud services. We may modify, suspend, or discontinue cloud-dependent features at any time. Core local functionality (such as manual control of smart bulbs through a switch) is not affected by service changes.

7. Limited Product Warranty

• LIFX warrants to the original purchaser that its products are free from defects in materials and workmanship for the warranty period specified on the product packaging or in Section 4 above. This warranty is non-transferable and applies only to products purchased from LIFX or an authorized retailer.
  
  
• This warranty does not cover: damage caused by accident, misuse, neglect, unauthorized modification, improper installation, or use outside the specifications on the product label; normal wear and tear, including lumen depreciation that does not exceed the rated life published for the product; products that have been repaired or modified by anyone other than LIFX or its authorized representatives; damage caused by operating products at improper voltage or with incompatible dimmers, ballasts, or drivers; cosmetic damage not affecting function; or products sold "as is" or "refurbished."
  
  
• LIFX's sole obligation under this warranty is, at its option, to repair or replace the defective product or to refund the original purchase price. Replacement products may be new or refurbished. To make a warranty claim, follow the procedures described in the Warranty Policy and submit a warranty request with proof of purchase.

EXCEPT FOR THE LIMITED WARRANTY ABOVE, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIFX AND FEIT ELECTRIC COMPANY, INC. DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LIFX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Intellectual Property

LIFX IP

All content on lifx.com and in the App, including text, graphics, logos, product images, software, and compilations thereof, is the property of LIFX, a brand of Feit Electric Company, Inc., or its content suppliers and licensors, and is protected by U.S. and international copyright, trademark, patent, and trade secret laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property other than the limited licenses expressly set forth herein. You may not copy, reproduce, distribute, or create derivative works of any such content without our express written permission.

Trademarks

Feit®, Feit Electric®, Cree Lighting®, LIFX®, Good Earth Lighting®, Universal®, Universal Security Instruments®, HomeBrite™, and Feit OTA™ are trademarks or registered trademarks of Feit Electric Company, Inc. Third-party trademarks mentioned on our sites (Amazon Alexa®, Google Assistant®, Apple®, Apple HomeKit®, etc.) are the property of their respective owners and are used for informational purposes only.

DMCA / Copyright Infringement

If you believe content on lifx.com infringes your copyright, please send a written notice to our designated DMCA agent. Your notice must comply with the requirements of 17 U.S.C. § 512(c)(3). Repeated infringers may have their access to the Services terminated.

User Content

If you submit any content to our websites or applications (including reviews, photos, or feedback), you grant LIFX a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, modify, display, and distribute that content in connection with our products and services. You represent that you have all necessary rights to grant this license and that your content does not violate any third-party rights or applicable law.

9. Prohibited Conduct

• You agree not to use the Services to: violate any applicable federal, state, local, or international law or regulation; transmit any unsolicited commercial email or spam; impersonate any person or entity, or misrepresent your affiliation with any person or entity; engage in any conduct that restricts or inhibits any person's use of the Services; attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services; transmit any malware, ransomware, viruses, Trojan horses, worms, or other malicious code; scrape, crawl, or otherwise extract data from the Services through automated means without our express written permission; use the Services to harass, threaten, defame, or intimidate any person; or interfere with or disrupt the integrity or performance of the Services or servers or networks connected thereto.
  
  
• Violation of this Section may result in immediate termination of your account and access to the Services and may be referred to law enforcement authorities.

10. Third-Party Links and Services

The Services may contain links to third-party websites, applications, or services. These links are provided for convenience only. LIFX does not endorse, control, or assume responsibility for third-party content, privacy practices, or terms. You access third-party sites at your own risk. Third-party integrations (e.g., voice assistants, smart home platforms, or payment gateways) are governed by the respective third party's terms of service and privacy policies. LIFX is not responsible for the availability, accuracy, or terms of those services.

11. Privacy

Our Privacy Policy is incorporated into and forms part of these Terms. By using the Services, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.  The Privacy Policy further explains how we use cookies and similar technologies on the Services and your choices.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIFX, FEIT ELECTRIC COMPANY, INC., AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES OR PRODUCTS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF REVENUE, LOSS OF GOODWILL, PROPERTY DAMAGE, PERSONAL INJURY, OR COST OF SUBSTITUTE GOODS OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL LIFX'S OR FEIT ELECTRIC COMPANY, INC.'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LIFX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limitations above may not apply to you in full.

13. Indemnification

You agree to indemnify, defend, and hold harmless LIFX, Feit Electric Company, Inc. and their affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit through the Services.

14. Product Safety and Compliance

LIFX products are designed and tested to meet applicable safety standards, including UL listings and FCC Part 15 requirements where applicable. To ensure safe use:

• Use products only as described in the packaging and product documentation;
• Install light bulbs and fixtures only in luminaires rated for the wattage and base type specified;
• Do not use non-dimmable products with dimmers;
• Keep products away from moisture unless rated for wet or damp locations;
• Do not modify, disassemble, or attempt to repair smart devices; and
• Register your products and contact LIFX Support for current product safety or recall information.

Products regulated by the California Energy Commission (CEC) that are non-compliant with Title 20 are not available for sale or resale in California. Not all products are available in all states or countries.

15. Export Controls

The App, firmware, and other software components of the Services may be subject to U.S. export control laws, including the Export Administration Regulations (EAR). You may not export or re-export any such items to any destination, person, or entity prohibited by U.S. law, including without limitation countries subject to U.S. embargo or persons on the U.S. Treasury Department Specially Designated Nationals list or the Commerce Department Entity List. By using the Services, you represent and warrant that you are not located in, a citizen or resident of, or under the control of any such country or on any such list.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to the arbitration agreement in Section 18, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California for any dispute not subject to arbitration.

17. Modifications to the Services

LIFX reserves the right to modify, suspend, or discontinue any part of the Services at any time without liability. We will endeavor to provide reasonable notice of material changes, particularly for changes that affect connected product functionality. LIFX is not liable to you or any third party for any modification, suspension, or discontinuation of the Services.

18. Dispute Resolution — Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES ARBITRATION OF MOST DISPUTES AND WAIVES YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS AND CLASS-WIDE ARBITRATION.

Informal Resolution

Before filing any claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved informally, either party may proceed to arbitration as described below.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services that is not resolved informally will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures (for claims under $250,000) or its Comprehensive Arbitration Rules and Procedures (for claims over $250,000), as applicable. The arbitration will be conducted in Los Angeles County, California, or by telephone or video conference at your election. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

YOU AND LIFX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. UNLESS BOTH YOU AND LIFX AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights or to address other urgent matters where irreparable harm would result without immediate relief. Claims that may be brought in small claims court are also exempt from mandatory arbitration.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you are opting out of arbitration. Opting out will not affect any other provision of these Terms.

19. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and LIFX with respect to the Services and supersede all prior agreements, understandings, and representations relating to the subject matter.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severed from the Terms and will not affect the validity and enforceability of the remaining provisions.

No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision unless we acknowledge and agree to it in writing.

Assignment

You may not assign or transfer these Terms or any rights hereunder without our prior written consent. LIFX may assign these Terms, including in connection with a merger, acquisition, or sale of assets, without restriction.

Force Majeure

We will not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, natural disaster, pandemic, government action, internet or telecommunications failures, or supply chain disruptions.
